PROGRESS UPDATES

On 10/13/09, Sen. Mark Udall (CO) introduced S. 1777, the Good Samaritan Cleanup of Abandoned Hardrock Mines Act of 2009.  The bill adds an additional type of NPDES permit to the Clean Water Act (Sec. 402) to limit liability of Good Samaritans when remediating abandoned or inactive mines.  It is very similar to H.R. 4011 which Udall introduced into the House of Representatives during the last congressional session.

So far there are two cosponsors: (D) Sen. Bennet – CO and (R) Sen. Risch – ID.  The bill has been referred to the Committee on Environment and Public Works.  No hearings have been scheduled.
